Claimant v Premier Block Management Limited T/A PBM Property Management
Outcome
Individual claims
The claim was struck out because the claimant did not have the required two years' continuous service to bring an ordinary unfair dismissal claim under section 94 of the Employment Rights Act 1996. The employment tribunal therefore had no jurisdiction to consider the claim.
Facts
Mr Dore brought a claim for ordinary unfair dismissal against his former employer, Premier Block Management Limited. The case proceeded to a preliminary hearing by CVP video link. The claimant appeared in person while the respondent was represented by counsel, Ms Kaye.
Decision
Employment Judge Skehan struck out the unfair dismissal claim on jurisdictional grounds. The claimant did not have the required two years' continuous service necessary to bring an ordinary unfair dismissal claim under section 94 of the Employment Rights Act 1996, and therefore the tribunal had no jurisdiction to hear the claim.
Practical note
This case reinforces the fundamental requirement that employees must have at least two years' continuous service to bring an ordinary unfair dismissal claim, and claims lacking this qualifying period will be struck out for lack of jurisdiction.
