Unlawful Deduction from Wagessucceeded

The Claimant worked for the Respondent but was unpaid for 4.642 months from 1 October 2024 to 18 February 2025. She resigned on 18 February 2025 by informing an administrator she was leaving. The Respondent also failed to pay her for accrued untaken holiday and failed to make pension contributions for over 18 months. The Respondent did not file a defence or attend the hearing.

Decision

The tribunal awarded the Claimant £26,858.92 comprising salary arrears, holiday pay, and unpaid pension contributions. Claims for notice pay and redundancy payment were dismissed because the Claimant resigned rather than being dismissed and did not have the required service for redundancy.

Practical note

In default judgment cases where the respondent fails to engage, tribunals will still require claimants to prove their claims with evidence, but will award sums claimed if properly evidenced, including wage arrears, holiday pay and pension contribution failures.
