Miss Robinson was employed by Middlesex Learning Trust on a fixed-term contract which was not renewed and ended on 31 August 2021. She discovered the non-renewal on 11 March 2021. She brought a successful disability discrimination claim. The tribunal found the non-renewal was discriminatory and awarded compensation for loss of earnings, pension loss, and injury to feelings, with the loss period running until 1 September 2023 when she was found to have failed to mitigate.
Decision
The tribunal awarded total compensation of £137,112 (including grossing up) comprising loss of earnings with interest (£49,421), pension loss (£26,284), and injury to feelings in the upper Vento band with interest (£33,015). The tribunal also made recommendations for disability awareness training and provision of a factual reference. Compensation was limited to the period up to 1 September 2023 due to failure to mitigate thereafter.
