Facts

Two claimants, Mr McLaughlin and Mr Chappell, brought claims against their former employer Basins, Pedestals and Loos Ltd (in creditors voluntary liquidation) and the Secretary of State for Business and Trade. The claims related to redundancy pay, wages, holiday pay and notice pay. The first respondent company was in liquidation and did not attend the hearing. Mr Chappell withdrew his claim at the hearing.

Decision

The tribunal dismissed Mr Chappell's claims on withdrawal. Mr McLaughlin's claims for redundancy pay, wages, holiday pay and notice pay were all found not to be well founded and were dismissed. No awards were made to either claimant.

Practical note

Claims against insolvent employers and the Secretary of State for statutory payments require claimants to prove entitlement, and mere assertion of claims is insufficient without supporting evidence.
