Discrimination Arising from Disability (s.15)(disability)succeeded

Claimant dismissed because of sickness absence arising from her fibromyalgia. Tribunal found the dismissal was not a proportionate means of achieving the respondent's legitimate aims because claimant had been inadequately supported through redeployment process and could have remained on redeployment register for the three months notice period she was paid in lieu for, with no obvious detriment to respondent.

Succeeded in respect of PCP requiring claimant to work in larger wards. Tribunal found combination of larger/busier wards and longer shifts put claimant at substantial disadvantage due to her fibromyalgia. Respondent failed to provide proper HR/managerial support through redeployment process as required by its own policy and should have extended redeployment period. Failed in respect of PCP requiring claimant to work in environment of conflict with Michelle France, as this did not have characteristic of repetition required for a PCP and respondent took quick steps to resolve by moving claimant from Ward 10.

Facts

Polish claimant employed as floating ward catering assistant at NHS Trust from July 2022, diagnosed with fibromyalgia October 2022. Alleged harassment by housekeeper Michelle France in February 2023. Went off sick February 2023 with fibromyalgia flare-up. Occupational health recommended working smaller wards and reduced hours. Claimant struggled on larger, busier wards with longer shifts which exacerbated fibromyalgia. Respondent failed to adequately support claimant through redeployment process. Dismissed September 2023 after panel concluded she could not return to role.

Decision

Harassment claims struck out as over 7 months out of time and not just and equitable to extend due to impact of delay on evidence. Section 15 discrimination claim succeeded as dismissal was not proportionate means of achieving legitimate aim where claimant inadequately supported through redeployment. Reasonable adjustments claim partly succeeded - respondent should have extended redeployment with proper support, but no duty regarding conflict with colleague as this was one-off incident quickly resolved.

Practical note

Where an employer has a redeployment policy setting out support to be provided, failure to follow that policy will make it difficult to show dismissal was proportionate under section 15 or that failure to extend redeployment was reasonable under section 20/21.
