Claimant v Glasgow City Council

19 June 2025Before Employment Judge Frances EcclesScotlandon papers

Outcome

Claimant fails

Individual claims

Otherstruck out

Claims struck out under rule 38(1)(d) for non-pursuit. Claimant's solicitors withdrew, claimant failed to respond to status enquiry, moved address without notifying tribunal, and tribunal unable to communicate with claimant.

Facts

The claimant's solicitors withdrew from acting on her behalf. The claimant failed to respond to the tribunal's status enquiry letter regarding her intention to pursue the claims. Correspondence sent to the claimant was returned as she no longer resided at the address on her ET1 form. The claimant did not notify the tribunal of her new address, making communication impossible.

Decision

The tribunal struck out the claims under rule 38(1)(d) for failure to actively pursue. The tribunal was unable to give notice under rule 38(2) due to the claimant's failure to provide an updated address. The tribunal assumed in these circumstances that the claimant no longer wished to pursue her claims.

Practical note

Claimants must keep the tribunal informed of their current contact details, as failure to do so can result in strike-out for non-pursuit when the tribunal cannot communicate with them.
