Discrimination Arising from Disability (s.15)(disability)struck out

Struck out for failure to comply with Unless Order dated 10 February 2025. Failure to Make Reasonable Adjustments(disability)struck out

Struck out for failure to comply with Unless Order. Claimant mentioned lack of proper adjustments, role changes, or responsibilities but failed to provide sufficient detail about the impairments, when respondent knew of them, and specific failures to adjust as required by the Unless Order.

Unfair Dismissalnot determined

This claim remains live and is listed for full merits hearing on 4, 5 and 6 February 2026. No determination has been made on this claim at this stage.

Facts

The claimant brought disability discrimination claims against her former employer John Lewis plc. An Unless Order was made on 10 February 2025 requiring her to provide detailed information about her disability, how it affected her, when the respondent knew about it, and specific allegations of discrimination. Despite attempting to comply by obtaining a GP letter, the claimant failed to provide sufficient detail on key aspects required by the order.

Decision

Employment Judge Keogh struck out all disability discrimination complaints for failure to comply with the Unless Order. The judge found the claimant had been given multiple opportunities to provide the necessary information but had not done so. The judge declined to give a further opportunity, finding it not in the interests of justice. The unfair dismissal claim remains listed for hearing in February 2026.

Practical note

Unless Orders must be complied with fully and precisely; partial or attempted compliance is insufficient, and unrepresented claimants pursuing disability discrimination must provide clear particulars enabling respondents to know the case they face.
