Facts
Mr Parker brought claims against his former employer Bupa Occupational Health Limited for various unauthorised deductions from wages and breach of contract. The claims included business and travel expenses, unpaid bonus, retained salary, holiday pay, and matters relating to private medical insurance. His employment ended in June 2024. He represented himself at the tribunal while the respondent was represented by counsel.
Decision
The tribunal upheld two of the claimant's claims: an unauthorised deduction of £797.10 relating to a retained salary payment and, by agreement between the parties, £964.52 in holiday pay. All other claims, including those relating to expenses, bonus, and medical insurance matters, were dismissed as not well-founded.
Practical note
Even where a claimant is unrepresented against a represented employer, tribunals will carefully assess each claim on its merits and may uphold some claims while dismissing others, particularly in cases involving multiple wage deduction allegations.
