Claimant v Weston Turville Golf Club Limited
Outcome
Individual claims
The tribunal determined under section 163 Employment Rights Act 1996 that the claimant was entitled to a statutory redundancy payment. The claimant was dismissed by reason of redundancy and met the qualifying criteria for payment.
The tribunal found the complaint of unfair dismissal was well-founded. The claimant was unfairly dismissed by the respondent. No compensatory award was claimed by the claimant beyond statutory entitlements.
The claimant was dismissed in breach of contract when he was not given his statutory minimum notice of 12 weeks' pay but was dismissed without notice on 8 January 2024. The tribunal awarded notice pay accordingly.
The claim for deductions from wages in respect of pension for October to December 2023 was well founded. The tribunal awarded compensation of £232.62 for these unlawful deductions.
Facts
Mr George was employed by Omega Leisure Management Ltd at a golf club. He was dismissed without notice on 8 January 2024 by reason of redundancy. He was entitled to 12 weeks' statutory notice but received none. The employer also made unlawful pension deductions during October to December 2023. The first respondent, Weston Turville Golf Club Ltd, had been dissolved in 2016 and was not the actual employer.
Decision
The tribunal found all claims succeeded. Mr George was unfairly dismissed and entitled to a statutory redundancy payment of £17,019. He was also awarded £6,804.36 net for notice pay and £232.62 for unlawful pension deductions. No compensatory award for unfair dismissal was claimed. The second respondent, Omega Leisure Management Ltd, was the correct employer.
Practical note
Employers dismissing for redundancy must provide statutory notice and maintain proper pension contributions; failure to do so results in additional liability for notice pay and unlawful deductions even where no compensatory award is claimed.
