The claim was submitted outside of the statutory time limits. The Tribunal considered that it was reasonably practicable for the Claimant to submit the claim within the statutory tribunal limit and therefore the Tribunal had no jurisdiction to determine the claim.
Facts
Mr Green brought claims for unauthorised deductions from wages and statutory redundancy payment against Groove Pad Ltd. The respondent did not attend the hearing. Both claims were submitted outside the statutory time limits for bringing such claims to the employment tribunal.
Decision
The tribunal dismissed both claims on jurisdictional grounds, finding that it was reasonably practicable for the claimant to have submitted the claims within the statutory time limits. As the claims were out of time and the claimant had not shown it was not reasonably practicable to comply, the tribunal had no jurisdiction to hear them.
Practical note
Claimants must strictly comply with statutory time limits for bringing employment tribunal claims, and will only receive an extension where they can demonstrate it was not reasonably practicable to present the claim in time.
