The claimant Ms Xhaferi brought claims against RBC Europe Ltd and Mr Jordanov. Prior to the scheduled hearing on 10 June 2025, the claimant applied for a postponement which was refused on 9 June 2025. She then applied to vary or set aside that refusal and made a further postponement application. The claimant did not attend the hearing scheduled for 10 June 2025.

The tribunal refused the claimant's application to vary or set aside the earlier postponement refusal, finding no change in material circumstances and that it was not in the interests of justice. The tribunal also refused the further postponement application and dismissed the claim for non-attendance, having considered all information provided by the claimant about her absence.

Practical note

Repeated postponement applications without material change in circumstances will be refused, and tribunals will dismiss claims for non-attendance even where reasons for absence are provided if those reasons are insufficient.
