Facts
The claimant Ms Nawaz brought a claim against Revolver Media Limited but failed to attend a preliminary hearing for case management scheduled for 28 May 2025. She had been properly notified by post and email with a notice dated 7 November 2024 and provided with a video hearing link. When the tribunal clerk telephoned her to explain the hearing was proceeding, the claimant hung up. The respondent also failed to attend.
Decision
The tribunal dismissed the claim under Rule 47 of the Employment Tribunal Rules of Procedure 2024 due to the claimant's non-attendance. After waiting fifteen minutes and attempting telephone contact which the claimant terminated, the tribunal waited a further ten minutes but received no communication from the claimant, who had made no contact since filing her claim form.
Practical note
Claimants must attend scheduled hearings and respond to tribunal communications or risk having their claims struck out for non-pursuit, even at preliminary case management stages.
