Facts

Mrs Shekar brought claims against her NHS employer. At a preliminary hearing on time limit issues, the tribunal found that certain claims identified in an earlier case management order were presented outside the applicable statutory time limits.

Decision

Employment Judge Bunting struck out the claims on the basis they were out of time and declined to extend time on just and equitable grounds. The claimant represented herself while the respondent was represented by counsel.

Practical note

Claimants must be aware of strict time limits in employment tribunal claims and the tribunal has discretion to refuse extensions even where claims are only slightly late if not just and equitable to extend.
