Direct Discrimination(race)failed

Tribunal found none of the alleged acts of discrimination occurred as alleged. For example: (1) Angela Lydon-Burgan did not allocate more CSPB meetings to the claimant - this was determined by the Screening and Immunisation Team; (2) the claimant was not required to work without a laptop for 6 months; (3) the underpayment affected both the claimant and a white colleague (Louise Hennessy) due to an administrative error, not race. The tribunal found the claimant's evidence inconsistent and largely inaccurate when compared to contemporaneous documentation.

Harassment(race)failed

Tribunal found that the alleged incidents of harassment either did not happen or were not related to race. For example: (1) Karen Burgess did not call the claimant the wrong name twice; (2) Diane Thornton did not laugh at the claimant at the 2 November 2020 meeting; (3) the 'thanks for popping in' incident did not happen as described; (4) Jonathan Gore did not make the alleged comments about bullying not being racial. Where incidents did occur (e.g. the friendly text message from Louise Hennessy in April 2023), they were not unwanted conduct and had no connection to race.

Facts

The claimant, a black Engagement and Interventions Manager, TUPE transferred from Capita to the respondent NHS body in August 2019. She was the only black member of her immediate team. She alleged multiple incidents of race discrimination and harassment between 2019-2021, including being allocated more meetings than white colleagues, not receiving IT equipment, being underpaid £483.05 in October 2020, and various incidents of alleged rudeness and exclusion. She resigned in December 2021 after her sick pay expired, claiming constructive dismissal. She raised a grievance in November 2020 which was rejected.

Decision

The tribunal dismissed all claims. It found the claimant's evidence inconsistent and inaccurate when compared to contemporaneous documents, while accepting the respondent witnesses as credible. The tribunal found that most alleged incidents either did not happen as described or had non-discriminatory explanations. The only breach found was the October 2020 underpayment, but this affected a white colleague too and was quickly rectified. The tribunal concluded the claimant resigned because her sick pay ran out, not due to any repudiatory breach, and that she had affirmed any breach by her conduct. Claims were also significantly out of time.

Practical note

A claimant's subjective belief that workplace incidents are race-related is insufficient without objective evidence linking the treatment to race, particularly where the employer can provide credible non-discriminatory explanations and where similar issues affected employees of different races.
