Individual claims

Otherstruck out

Struck out under Rule 38(1)(d) for failure to actively pursue the case. Claimant did not respond to tribunal letter dated 2 October 2024 or to strike out warning issued on 16 December 2024 by EJ Siddall.

Facts

Miss Nelson brought a claim against the Metropolitan Police. The tribunal sent her a letter on 2 October 2024 which she did not respond to. Employment Judge Siddall issued a strike out warning on 16 December 2024, but the Claimant again failed to respond. A full merits hearing had been scheduled for 2-13 June 2025.

Decision

Employment Judge Burge struck out the claim under Rule 38(1)(d) for failure to actively pursue the case, following the Claimant's failure to respond to tribunal correspondence and a strike out warning. The scheduled hearing was cancelled.

Practical note

Failure to respond to tribunal correspondence and strike out warnings will result in claims being struck out for non-pursuit under Rule 38(1)(d), even when a substantial hearing has been scheduled.
