Facts

Mrs Wilkinson brought claims of unfair dismissal, age discrimination and harassment related to age against Lancaster University. A preliminary hearing was held on 21 March 2025 at which a deposit order was made. The claimant failed to pay the required deposits.

Decision

Regional Employment Judge Franey struck out all three claims under rule 40(4) of the Employment Tribunal Procedure Rules 2024 because the claimant did not pay the deposits ordered at the preliminary hearing. The case is at an end.

Practical note

Failure to pay a deposit ordered by an employment tribunal will result in automatic strike-out of the claims under rule 40(4), bringing the case to an end without consideration of the merits.
