Facts

Mrs Watson brought a claim against South Ayrshire Council in 2013. The claim had not been actively pursued. The claimant failed to respond appropriately.

Decision

The Tribunal struck out the claim under rule 38(1)(d) of the Employment Tribunal Procedure Rules 2024 on the grounds that the claim had not been actively pursued. The claimant failed to provide an acceptable reason why the claim should not be struck out or to request a hearing.

Practical note
