Claimant v Sario Partners Limited
Outcome
Individual claims
The tribunal found that the respondent was in breach of contract for failing to pay the claimant's three months' notice period. The claimant was entitled to notice pay calculated at £17,499.00, which the respondent failed to provide upon termination of employment.
The tribunal determined that the claimant had accrued 18 days of untaken holiday at the time of termination. The respondent failed to pay for this accrued but untaken holiday, which the claimant was entitled to receive. The tribunal calculated this entitlement at £4,846.15.
Facts
Mr Oliver Boorn brought claims against his former employer, Sario Partners Limited, for failure to pay notice and accrued holiday pay. The claimant was entitled to three months' notice under his contract of employment. He had also accrued 18 days of untaken holiday at termination. The respondent, represented by director Mr J Mobbs, failed to pay either amount.
Decision
Employment Judge Postle found in favour of the claimant on both claims. The tribunal ordered the respondent to pay £17,499.00 for breach of contract (three months' notice pay) and £4,846.15 for 18 days of accrued holiday pay, totalling £22,345.15.
Practical note
Employers must ensure they pay all contractual notice and statutory holiday entitlements on termination, as failure to do so will result in successful tribunal claims for breach of contract and unlawful deduction of wages.
