Claimant v Scope

Outcome

Claimant fails

Individual claims

Unfair Dismissalstruck out

The complaint was not presented within the applicable time limit and the tribunal found it was reasonably practicable to have done so, therefore the claim was dismissed for being out of time.

Unlawful Deduction from Wagesstruck out

The complaint for arrears of pay was not presented within the applicable time limit and it was reasonably practicable to have presented it in time, therefore the claim was dismissed.

Direct Discrimination(race)struck out

The complaint was not presented within the applicable time limit and the tribunal found it was not just and equitable to extend the time limit, therefore the claim was dismissed.

Facts

Ms Ansah brought claims of unfair dismissal, unauthorised deductions from wages (arrears of pay), and race discrimination against her former employer, Scope, a charity. The claimant appeared in person at a preliminary hearing to determine whether her claims had been presented within the applicable time limits.

Decision

The tribunal dismissed all claims as having been presented outside the applicable time limits. For unfair dismissal and wages claims, the tribunal found it was reasonably practicable to present in time. For race discrimination, it was not just and equitable to extend time.

Practical note

Claimants must strictly observe time limits when bringing employment tribunal claims, as tribunals will dismiss claims presented out of time unless there are compelling reasons why it was not reasonably practicable (for statutory claims) or just and equitable (for discrimination claims) to present them in time.
