2 May 2025Before Employment Judge R S DrakeLeedsremote video

Outcome

Default judgment

Facts

Lisa Flannery brought claims against F&P Huddersfield Ltd (first respondent) and Alistair Ferrie (second respondent). The first respondent failed to file a response despite the ET1 being sent to their trading and registered office addresses. The tribunal held a private preliminary hearing by videolink at which the claimant appeared in person and the respondent did not appear.

Decision

The tribunal granted default judgment to the claimant under Rule 22 of the Employment Tribunals Rules of Procedure 2024 in respect of all her heads of claim against the first respondent. The respondent will not be permitted to take part in future proceedings without leave of the judge at any future hearing.

Practical note

This is a default judgment case where the respondent's failure to file a response resulted in judgment being entered for the claimant on all claims, with remedy to be determined at a future hearing.
