Facts
Mr Taylor brought a claim against ISS Facility Services Limited. The Tribunal made case management orders on 18 October 2024 with which the claimant failed to comply. The Tribunal sent a warning letter on 24 February 2025 inviting representations as to why the claim should not be struck out, but received no response from the claimant.
Decision
Employment Judge Camp struck out the claim on the basis that the claimant had not complied with Tribunal orders and had not actively pursued his claim. The judge concluded it appeared the claimant had abandoned the claim and that striking it out was in accordance with the overriding objective.
Practical note
Claimants must comply with case management orders and actively pursue their claims, or risk having their claims struck out for non-compliance even before a hearing on the merits.
