Following a warning letter dated 27 March 2025 giving the claimant a further opportunity to comply, explain non-compliance, or request a hearing, the claimant failed to respond.
Decision
Employment Judge Spencer struck out the claim pursuant to Rule 38 of the ET Rules of Procedure 2024 due to the claimant's failure to comply with tribunal orders and failure to respond to the warning letter. The scheduled hearing for 22-24 July 2025 was cancelled.
Practical note
Claimants who fail to comply with tribunal orders and do not respond to warning letters risk having their claims struck out for non-pursuit under Rule 38.
