Tribunal struck out this complaint against UNISON in its entirety following the First Respondent's strike-out application of 16 January 2025.
Facts
Mr Manneh brought claims of direct discrimination and harassment against UNISON (First Respondent) and Aneurin Bevan University Health Board (Second Respondent). The claims against UNISON related to allegations including an email sent on 19 August 2020. UNISON applied to strike out the claims on 16 January 2025. A remote hearing took place on 22 April 2025.
Decision
The tribunal granted permission for the claimant to withdraw his direct discrimination claim concerning the 19 August 2020 email. It also struck out the remaining direct discrimination and harassment claims against UNISON in their entirety. UNISON was discharged as a party to the proceedings. The claims against the Second Respondent remain live.
Practical note
Strike-out applications can successfully remove a respondent entirely from proceedings where claims lack reasonable prospects of success or are otherwise deficient, even where the claimant is represented.
