The judgment upholding the victimisation claim was revoked by consent following a reconsideration application. The claimant had misunderstood the grounds of claim and accepted the judgment should not have been extended to her. The claim was dismissed by consent.
Facts
This case was part of a large group claim proceeding under Broadbent v The Police Federation of England and Wales. A judgment dated 14 February 2024 had upheld the claimant's claims of age discrimination and victimisation. The claimant, through her solicitors Leigh Day, applied for reconsideration in March 2025, explaining she had misunderstood the grounds of claim. She accepted the judgment should not have been extended to her and did not wish to seek compensation to which she was not entitled.
Decision
The tribunal granted the reconsideration application despite it being out of time, finding it in the interests of justice to do so. The tribunal accepted the claimant's explanation that an error had been made in a large multiple case involving thousands of claimants, revoked the previous judgment upholding her claims, and dismissed her case by consent.
Practical note
In large group litigation, errors can occur where claimants are inadvertently included in successful claims; tribunals will exercise discretion to rectify such errors on reconsideration where brought to their attention promptly and in good faith.
