8 April 2025Before Employment Judge Suzanne PalmerEast Londonin person

Outcome

Claimant fails

Individual claims

Otherstruck out

The claim was struck out in its entirety because it disclosed no identifiable claim over which the Tribunal has jurisdiction and therefore had no reasonable prospects of success. The claimant's application to amend the claim was also refused.

Facts

Ms Ali brought a claim against London Underground Limited. She applied to amend her claim on 31 January 2025. At a preliminary hearing on 8 April 2025, the tribunal considered both the amendment application and the substantive claim. The claimant represented herself with assistance from Ms A Carney, while the respondent was represented by counsel.

Decision

The tribunal refused the claimant's application to amend and struck out the entire claim under Rule 38(1)(a). The strike-out was ordered on the basis that the claim disclosed no identifiable claim over which the tribunal had jurisdiction and therefore had no reasonable prospects of success.

Practical note

A claim must disclose an identifiable cause of action within the tribunal's jurisdiction; failure to do so will result in strike-out for having no reasonable prospects of success.
