Claimant v London Underground Limited
Outcome
Individual claims
The claim for wrongful dismissal was brought out of time. The tribunal determined that it did not have jurisdiction to hear the claim as the statutory time limit had expired and the claim was dismissed.
The claim for disability discrimination was brought out of time. The tribunal determined that it did not have jurisdiction to hear the claim as the statutory time limit had expired and the claim was dismissed.
Facts
Mr Abdullah Manik brought claims against London Underground Ltd and three individual respondents for wrongful dismissal and disability discrimination. The matter came before Employment Judge Adkin at a preliminary hearing conducted remotely by CVP on 4 April 2025. The claimant represented himself while the respondents were represented by counsel.
Decision
The tribunal dismissed both claims on the basis that they were brought out of time. The wrongful dismissal and disability discrimination complaints were determined to be outside the statutory time limits for bringing such claims, and the tribunal found it had no jurisdiction to hear them.
Practical note
Time limits in employment claims are strictly enforced; claimants must ensure claims are filed within the applicable limitation periods or risk having their claims dismissed at a preliminary stage without consideration of the merits.
