Claimant v Ben Ikin
Outcome
Individual claims
The tribunal found that the second respondent made unauthorised deductions from the claimant's wages covering unpaid wages from 1 October 2023 to 11 October 2024 and unpaid pension contributions from August 2022 to 11 October 2024. The respondents did not attend the hearing to defend the claim.
Facts
The claimant, Mr Slevin, was employed by the second respondent company, Originate (Manchester) Ltd. Between October 2023 and October 2024, the employer failed to pay wages owed to the claimant. Additionally, from August 2022 to October 2024, the employer failed to make required pension contributions. The claimant's employment ended on 11 October 2024. Neither the first nor second respondent attended the hearing.
Decision
The tribunal found in favour of the claimant on his claim of unauthorised deductions from wages. The respondent had made unlawful deductions totalling £19,112.30, covering both unpaid wages over a 13-month period and unpaid pension contributions over approximately two years. The tribunal ordered the second respondent to pay this amount.
Practical note
When employers fail to defend wage claims and do not attend hearings, tribunals will assess claims on the evidence presented and award full unpaid wages and pension contributions where proven.
