26 March 2025Before Employment Judge Frances EcclesScotlandon papers

Outcome

Claimant fails

Individual claims

Otherstruck out

Claim struck out for non-pursuit under rule 38(1)(d). Claimant was given until 5 March 2025 to provide reasons or request a hearing but failed to respond or provide acceptable reasons.

Facts

Ms Trusser brought a claim against Cordia Services LLP and Glasgow City Council. The tribunal issued an unless order on 19 February 2025 giving the claimant until 5 March 2025 to provide written reasons why the claim should not be struck out or to request a hearing. The claimant failed to respond or comply with the order.

Decision

The tribunal struck out the claim under rule 38(1)(d) on the grounds that it has not been actively pursued. The claimant was given a clear opportunity to respond but failed to provide acceptable reasons or request a hearing to explain the lack of active pursuit.

Practical note

Unrepresented claimants must respond promptly to tribunal orders and unless orders, as failure to do so will result in strike-out for non-pursuit.
