Facts

Ms Craig brought claims against Cordia Services LLP and Glasgow City Council. On 21 February 2025, the Tribunal gave the claimant until 7 March 2025 to provide written reasons why the claims should not be struck out for non-pursuit, or to request a hearing. The claimant failed to respond with acceptable reasons or request a hearing.

Decision

The Tribunal struck out all claims under rule 38(1)(d) of the Employment Tribunal Procedure Rules 2024 on the grounds that the claims had not been actively pursued. The claimant was given a fair opportunity to respond but failed to do so.

Practical note

Tribunals will strike out claims for failure to actively pursue when claimants fail to engage with the tribunal process, even after being given explicit warnings and opportunities to respond.
