Otherstruck out

Claim struck out under rule 38(1)(d) for failure to actively pursue. Claimant failed to respond to tribunal's unless order requiring written reasons by 27 January 2025 or to request a hearing, and failed to provide acceptable reasons why claim should not be struck out.

Facts

Mrs Collins brought a claim against Glasgow City Council and Glasgow Life in 2010. The claim was not actively pursued. On 13 January 2025, the tribunal issued an unless order requiring the claimant to provide written reasons by 27 January 2025 why the claim should not be struck out, or to request a hearing. The claimant failed to comply with this order.

Decision

The tribunal struck out the claim under rule 38(1)(d) of the Employment Tribunal Procedure Rules 2024 on grounds that it had not been actively pursued. The claimant failed to respond to the unless order or provide acceptable reasons why the claim should not be struck out.

Practical note

Claims that are not actively pursued will be struck out, particularly where claimants fail to comply with unless orders requiring them to show cause why the claim should continue.
