Claimant v BB Healthcare Solutions Limited
Outcome
Individual claims
This is a reconsideration application of a judgment sent 30 January 2025. The tribunal refused reconsideration finding no reasonable prospect of the original decision being varied or revoked. The case was determined on facts found based on evidence before the tribunal, and there was lack of evidence to substantiate the claimant's case.
Facts
Claimant worked for respondent BB Healthcare Solutions Ltd from 2016 on a zero-hours contract. She brought claims following a grievance she raised which she alleged was not properly addressed. The claimant had previously had a settlement with London Road Surgery regarding a separate matter. The claimant alleged various procedural failings by the respondent and issues with bundle preparation and witness statements.
Decision
The tribunal refused the claimant's application for reconsideration dated 12 February 2025 of the judgment sent on 30 January 2025. The tribunal found no reasonable prospect of the original decision being varied or revoked. The tribunal noted that the case was determined on the facts found and there was a lack of evidence to substantiate the claimant's case.
Practical note
A reconsideration application raising numerous procedural objections and allegations of bias will be refused where the tribunal gave the unrepresented claimant extensive latitude to present evidence and there is no reasonable prospect of varying the original decision.
