Individual claims

Otherstruck out

Claim struck out under rule 38(1)(d) for failure to actively pursue the claim. Claimant failed to respond to tribunal's unless order by 4 February 2025 giving reasons why claim should not be struck out or requesting a hearing.

Facts

Ms Russell brought a claim against Glasgow City Council in 2010. On 21 January 2025, the Tribunal issued an unless order giving the claimant until 4 February 2025 to provide written reasons why the claim should not be struck out or to request a hearing. The claimant failed to respond to the unless order.

Decision

The Tribunal struck out the claim under rule 38(1)(d) of the Employment Tribunal Procedure Rules 2024 on the grounds that the claim had not been actively pursued. The claimant failed to comply with the unless order and did not provide acceptable reasons or request a hearing.

Practical note

Compliance with unless orders is mandatory; failure to respond to a tribunal direction regarding strike-out will result in the claim being struck out for non-pursuit.
