Claimant v Metropolitan Police Service

Outcome

Other

Facts

This is a reconsideration application following a full merits hearing judgment dated 17 March 2025. The claimant, Ms Catesby, brought claims against the Metropolitan Police and two individual respondents. The full merits hearing resulted in a judgment adverse to the claimant. She applied for reconsideration on 14 May 2025 alleging procedural unfairness and seeking to restate her case.

Decision

The tribunal refused the reconsideration application. The judge found that the application largely restated the claimant's case which had already been fully considered at the merits hearing. Allegations of procedural unfairness were rejected; the tribunal had followed normal procedure, the panel had read the file after initial matters, and the claimant had been given full opportunity to participate and make closing submissions.

Practical note

A reconsideration application cannot succeed merely by restating the same case with different emphasis or alleging procedural unfairness where normal tribunal procedures were properly followed.
