Claim struck out under rule 38(1)(d) for failure to actively pursue the claim. Claimant failed to respond to tribunal's opportunity to provide reasons by 31 January 2025 or request a hearing.

Facts

Miss Kwasna brought a claim against Glasgow City Council and Cordia (Services) LLP. On 17 January 2025, the tribunal gave the claimant until 31 January 2025 to provide written reasons why the claim should not be struck out, or to request a hearing. The claimant failed to respond or provide an acceptable reason.

Decision

The tribunal struck out the claim under rule 38 of the Employment Tribunal Procedure Rules 2024 on the grounds that the claim had not been actively pursued. The claimant's failure to respond to the tribunal's unless order justified the strike out.

Practical note

Claimants must actively pursue their claims and respond to tribunal directions; failure to do so will result in the claim being struck out under rule 38(1)(d).
