Outcome
Individual claims
The tribunal heard the case on its merits with the claimant appearing in person and the respondent not attending. After considering the evidence and submissions, the tribunal found the complaint of direct sex discrimination was not well-founded and dismissed it.
Facts
Mr Ramos brought a claim of direct sex discrimination against his former employer, Simy's Whippy, a business operating in the hospitality sector. The case proceeded to a full hearing at Watford Employment Tribunal on 28 February 2025. Mr Ramos represented himself and the respondent did not attend the hearing.
Decision
Employment Judge Dick heard the case and found that the complaint of direct sex discrimination was not well-founded. The claim was dismissed. Written reasons were delivered orally at the hearing but are not included in this judgment.
Practical note
Even where a respondent does not attend, the claimant must still prove their discrimination case on the merits and satisfy the tribunal that the claim is well-founded.
