The claimant had previously brought an identical claim numbered 2402732/2024, which he had withdrawn and was dismissed by the tribunal. The current claim was therefore a duplicate filing.
Decision
Employment Judge Greer struck out the claim on the grounds that it was a duplicate of an earlier claim that had already been dismissed following the claimant's withdrawal. The tribunal noted that a separate linked matter (case 2404464/2024) remained active and was not struck out.
Practical note
A claimant cannot bring a duplicate claim after withdrawing an earlier identical claim; such duplicate claims will be struck out as an abuse of process.
