Claimant v Surrey County Council
Outcome
Individual claims
The tribunal found the complaint well-founded. The respondent made an unauthorised deduction from the claimant's wages in the period April-May 2024. Although the amount due had subsequently been paid by the time of the hearing, the deduction was unlawful when made.
Facts
Mr Welsh brought a claim for unauthorised deduction of wages against Surrey County Council relating to the period April-May 2024. By the time of the hearing, the respondent had paid the amount that had been deducted. The claimant appeared in person while the respondent was represented by counsel.
Decision
The tribunal found the claim well-founded, ruling that the respondent had made an unauthorised deduction from wages during April-May 2024. Although the wages had since been paid, the tribunal awarded the claimant £20 to compensate for financial loss attributable to the unlawful deduction.
Practical note
Even where an employer retrospectively pays wages that were unlawfully withheld, the tribunal can still award compensation for financial losses caused by the period of non-payment.
