Claimant v DPD Group UK Limited
Outcome
Individual claims
Claim struck out for non-compliance with Tribunal Order dated 06 November 2024 and failure to actively pursue the claim. Claimant failed to make representations or request a hearing in response to the Tribunal's letter dated 18 February 2025.
Facts
Mr Jeffery brought a claim against his former employer DPD Group UK Ltd. The Tribunal made an Order on 06 November 2024 with which the claimant failed to comply. The Tribunal wrote to the claimant on 18 February 2025 inviting representations as to why the claim should not be struck out for non-compliance and failure to actively pursue the claim. The claimant did not respond.
Decision
Employment Judge McTigue struck out the claim on the papers after the claimant failed to comply with a Tribunal Order and failed to respond to the Tribunal's letter inviting representations. The hearing scheduled for 27 February 2025 was cancelled.
Practical note
Claimants must comply with Tribunal orders and actively pursue their claims; failure to engage with the Tribunal process will result in the claim being struck out.
