Claimant v Bidvest Noonan (UK) Limited
Outcome
Individual claims
Claim struck out for non-pursuit after the claimant failed to comply with Tribunal Orders dated 27th September 2024 and 10th January 2025, and failed to make representations or request a hearing when given the opportunity on 7th February 2025.
Facts
Mr Edwards brought a claim against Bidvest Noonan (UK) Limited. The Tribunal issued Orders on 27th September 2024 and 10th January 2025 with which the claimant failed to comply. On 7th February 2025, the Tribunal wrote to the claimant giving him an opportunity to make representations or request a hearing as to why his claim should not be struck out for non-pursuit. The claimant did not respond.
Decision
Employment Judge Heap struck out the claim on the papers after the claimant failed to comply with two previous Tribunal Orders and failed to respond to the unless order warning. The scheduled hearing for September 2026 was cancelled.
Practical note
Failure to comply with Tribunal Orders and failure to actively pursue a claim will result in strike-out, even where a full merits hearing has been listed.
