Claimant v Paper London Limited (In Administration)

Individual claims
The tribunal found that the claimant was unfairly dismissed by the respondent. The respondent did not attend to contest the claim. The tribunal proceeded to determine the claim in the respondent's absence and found in favour of the claimant on the unfair dismissal claim.
Facts
Ms K Townsend brought an unfair dismissal claim against her former employer, Paper London Limited, which was in administration. The respondent did not attend the hearing held by video at Bury St Edmunds on 3 February 2025. The claimant represented herself at the hearing.
Decision
Employment Judge Graham found that the claimant was unfairly dismissed and awarded her a basic award of £6,852. The tribunal proceeded in the absence of the respondent and determined the claim based on the evidence presented by the claimant.
Practical note
When a respondent company in administration fails to attend a tribunal hearing, the tribunal will proceed to determine the claim in their absence and may find for the claimant if the evidence supports their case.
