Facts
The claimant, a black African Caribbean Christian support officer, claimed harassment after a comment made by white colleague Miss Shone on 17 July 2023. The claimant failed to attend his shift on 4 June 2023 due to a genuine error, which Miss Shone had to cover. On 17 July, during a conversation about the missed shift, Miss Shone made a comment referencing a voodoo doll. The claimant alleged she said 'I should have sent you a voodoo doll with pins in it'. The Tribunal found she actually said 'I'm like a voodoo doll with needles in her eyes' referring to her own exhaustion. The claimant was on long-term sickness absence from 21 July 2023, which he attributed to this incident.
Decision
The Tribunal found that whilst Voodoo/Voodooism is a protected religion/belief under the Equality Act 2010, and the comment related to race and religion/belief, it did not amount to harassment. The comment did not have the purpose of harassment as it referred to Miss Shone's own exhaustion. It did not have the effect of harassment because the claimant misheard/misremembered it, it was not directed at him, and it was not reasonable for it to have that effect in the circumstances. The claim was dismissed.
Practical note
Even where a comment relates to a protected characteristic, it will not amount to harassment if it was not directed at the claimant and it is not reasonable for it to have the harassing effect, particularly where the claimant has misheard or misremembered what was actually said.
