Facts

Mrs Howat brought a claim against Glasgow City Council in 2008. By September 2024, the claim had not been actively pursued. The tribunal issued an order on 11 September 2024 requiring the claimant to provide written reasons by 25 September 2024 or request a hearing to explain why the claim should not be struck out. The claimant failed to respond to this order.

Decision

Employment Judge Eccles struck out the claim under rule 37(1)(d) for failure to actively pursue it. The claimant did not provide acceptable reasons why the claim should not be struck out and did not request a hearing despite being given the opportunity to do so.

Practical note

Claimants must actively engage with tribunal proceedings and respond to orders, or risk having their claims struck out for non-pursuit even in long-running cases.
