Throughout the entire period of their engagement, the respondent made no payments of wages to either claimant. The second claimant had received only a £60 advance payment. The respondent failed to attend the tribunal hearing or provide any defence to the claims.
Decision
The tribunal found in favour of both claimants, declaring that the respondent had made unauthorised deductions of wages by failing to pay any wages throughout the employment period. The first claimant was awarded £7,200 in unpaid wages, and the second claimant was awarded £3,297.38 (after deducting the £60 advance already paid).
Practical note
Employers who completely fail to pay workers any wages throughout their employment will face successful unauthorised deduction claims, particularly where they fail to defend the proceedings.
