Claimant v Whitbread Group Plc
Outcome
Individual claims
The tribunal found that the Claimant was not contractually entitled to be paid a bonus by the Respondent on expiry of his fixed term contract. Therefore, the Respondent made no unlawful deduction of wages from him.
The claim for other payments relating to the bonus failed because the tribunal determined there was no contractual entitlement to the bonus payment claimed.
Facts
Mr Dilley was employed by Whitbread Group Plc on a fixed term contract. At the expiry of his fixed term contract, he claimed he was entitled to a bonus payment. The dispute centred on whether he had a contractual entitlement to receive the bonus.
Decision
The tribunal dismissed the claim, finding that the Claimant had no contractual entitlement to the bonus payment. Consequently, there was no unlawful deduction of wages when the Respondent did not pay the bonus on expiry of the fixed term contract.
Practical note
Employers are not required to pay bonuses at the end of fixed term contracts unless there is a clear contractual entitlement to such payment.
