Facts

Miss A Murray brought a claim against Glasgow City Council and Cordia (Services) LLP in 2009. On 12 August 2024, the tribunal gave the claimant until 26 August 2024 to provide written reasons why the claim should not be struck out or to request a hearing. The claimant failed to respond to this order or request a hearing.

Decision

The tribunal struck out the claim under rule 37(1)(d) on the grounds that the claim had not been actively pursued. The claimant failed to give acceptable reasons why the claim should not be struck out and failed to request a hearing despite being given the opportunity to do so.

Practical note

Claimants must actively pursue their claims and respond to tribunal orders, or risk having their claims struck out for non-pursuit regardless of how long the case has been pending.
