Claim struck out for non-pursuit under rule 37(1)(d). Claimant failed to respond to Tribunal's order dated 12 September 2024 requesting written reasons by 26 September 2024 or requesting a hearing to show why claim should not be struck out.

Facts

Mrs Conroy brought a claim against Glasgow City Council in 2008. The claim remained dormant for many years. On 12 September 2024, the Tribunal gave the claimant until 26 September 2024 to provide written reasons why the claim should not be struck out or to request a hearing. The claimant failed to respond.

Decision

The Tribunal struck out the claim under rule 37(1)(d) on the grounds that it had not been actively pursued. The claimant was given an opportunity to show cause but failed to provide acceptable reasons or request a hearing.

Practical note

Tribunals will strike out claims for non-pursuit where claimants fail to respond to unless orders, even in long-standing cases.
