Facts
Mrs Clisby brought a claim against Surrey County Council. The Tribunal issued an order on 17 March 2024 with which the claimant failed to comply. On 02 December 2024 the Tribunal wrote to the claimant giving her an opportunity to make representations or request a hearing as to why the claim should not be struck out for non-compliance and failure to actively pursue the claim. The claimant did not respond.
Decision
Employment Judge George struck out the claim on the papers on 10 January 2025 due to the claimant's failure to comply with the Tribunal's order and failure to actively pursue her claim. The scheduled hearing for 12-14 February 2025 was cancelled.
Practical note
Claimants must comply with tribunal orders and actively pursue their claims or risk strike-out, even without a hearing if they fail to respond to warnings.
