Constructive Dismissalstruck out

Claim struck out for failure to actively pursue the case and non-compliance with tribunal orders. Claimant failed to provide required details despite being ordered to do so.

Facts

The claimant brought claims of harassment, failure to make reasonable adjustments, and constructive dismissal against his employer, an NHS ambulance service. Following a case management hearing in June 2024, the tribunal made orders for the claimant to clarify his claims and provide further information. Despite submitting 642 pages of documents in August 2024, the claimant failed to provide the specific clarifications ordered. A consent order in September 2024 required further information by 28 October 2024, which was not provided. The claimant cited deteriorating mental health but failed to provide supporting evidence or apply for a postponement despite being invited to do so.

Decision

The tribunal struck out all claims on 10 January 2025 for failure to actively pursue the case and non-compliance with tribunal orders. The judge found that despite two case management hearings, the issues remained unclear and the claimant had repeatedly failed to comply with orders. It was appropriate and proportionate to strike out the claims given the claimant's continued non-compliance even after being warned.

Practical note

Self-represented claimants with mental health difficulties must still comply with tribunal orders and provide medical evidence when seeking extensions or postponements, or risk strike-out for non-pursuit.
