Outcome
Individual claims
Struck out for non-pursuit. The claimant failed to comply with case management orders and did not respond to the tribunal's letter of 13 December 2024. The tribunal concluded the case was not being actively pursued and a fair hearing was no longer possible.
Facts
The claimant P Hughes brought a claim against Royal Mail. The claimant failed to comply with case management orders and did not respond to a letter from Employment Judge Holmes dated 13 December 2024. A hearing had been scheduled for 22 January 2025.
Decision
Employment Judge Tobin struck out the claim on the basis that the claimant had not complied with case management orders, had not responded to the tribunal's communications, and had not actively pursued the case. The tribunal also determined that a fair hearing was no longer possible due to the claimant's failure to comply with the tribunal's efforts to get case preparation back on track.
Practical note
Claimants must comply with case management orders and respond to tribunal communications or risk having their claims struck out for non-pursuit.
