Claimant v Cleaning Operations LTD UK

8 January 2025Before Employment Judge Liveseyon papers

Outcome

Claimant fails

Individual claims

Otherstruck out

Claim struck out for non-pursuit after claimant failed to make representations or request a hearing following tribunal's unless order dated 26 November 2024.

Facts

The claimant brought an employment claim against her former employer, a cleaning company. On 26 November 2024, the tribunal issued an unless order giving the claimant the opportunity to make representations or request a hearing as to why the claim should not be struck out for non-pursuit. The claimant failed to respond or make sufficient representations.

Decision

The tribunal struck out the claim on 8 January 2025 because the claimant had failed to actively pursue it by not responding to the unless order. The scheduled hearing for 7 February 2025 was cancelled.

Practical note

Failure to respond to a tribunal's unless order will result in automatic strike-out of the claim for non-pursuit, even without a hearing.
